The Service includes AI-powered features such as the Lizzi operations agent and Sally digital marketing agent. You acknowledge that:

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONSTER CREATIVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless MiOpsAI and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
Customer-initiated cancellation: You may cancel your subscription at any time by submitting written notice to billing@miopsai.io. Cancellation requires a sixty (60) day written notice period. You remain responsible for all subscription fees during the 60-day notice period, regardless of whether you continue to use the Service. Service access continues uninterrupted during the notice period to support data export and workflow transition. Annual plans are prepaid for 12 months and cannot be refunded mid-term, but will not auto-renew if you provide 60 days written notice prior to the renewal date.
No free trials or money-back guarantees: MiOpsAI does not offer free trials, freemium tiers, or money-back guarantees. Customers are encouraged to evaluate the Service through our pre-signup walkthrough before subscribing.
MiOpsAI-initiated termination: We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Nebraska.
